Law and Ethics for Behavioral Health Providers

Course Description:

Training for BHRS Providers to include a review of new legislation affecting behavioral healthcare providers and their patients, new confidentiality regulations impacting substance use disorder treatment providers who must follow 42 CFR Part 2, a general review of confidentiality regulations for all providers, consent and non-consent issues, including minor consent, and a review of the legal and ethical issues raised by certain hot topics currently facing healthcare providers.

Course Objectives:

  1. Providers will be able to describe and follow new state laws regarding gender discrimination in healthcare settings, changes in the elder abuse & neglect reporting laws that add substance use counselors to the list of other healthcare providers who are mandated reporters, and the new CURES 2.0 legislation and guidelines for providers who treat chronic pain;
  2. Providers will learn how new 42 CFR Part 2 regulations impact their handling of substance use disorder records, and will be able to explain the new definitions, and recognize new limitations they will be subject to when sharing information with third parties and with other County staff working on multi-disciplinary teams such as Whole Person Care projects; and
  3. Providers will be able to explain how the HIPAA “treatment purposes” exception to privacy applies to behavioral health records, and will be able to describe the state laws that protect mental health information, as well as 42 CFR Part 2 regulations that protect substance use disorder information; they will learn about new state laws permitting the sharing of information with first responders and emergency department staff in an emergency, and the new parameters for sharing substance use disorder information in a bona fide emergency
